DeGo mobile app — Regulation of access, use and ordering of food delivery.

1. Identification of the owner

The DeGo mobile application is owned by:

  • DEGO DELIVERY SL

Hereinafter, "DeGo" or the "Platform".

2. Purpose

These Terms and Conditions govern the access, use and ordering of food delivery through the DeGo mobile application.

The use of the App implies full and unreserved acceptance of these conditions.

3. Nature of the service

DeGo acts as a technological intermediation platform between:

  • Consumer users who place food orders.
  • Partner restaurants that prepare the products.
  • Riders employed by DEGO DELIVERY SL who carry out the delivery.

DeGo does not prepare or handle the food products offered by the restaurants.

The restaurants are solely responsible for:

  • The quality, condition and food safety of the products.
  • Information about ingredients and allergens.
  • Compliance with applicable health regulations.

4. Requirements for using the App

To use DeGo, you must:

  • Be at least 18 years of age.
  • Create an account providing truthful and up-to-date information.
  • Expressly accept these Terms and the Privacy Policy.

Use of the App by minors is not permitted.

The user is responsible for safeguarding their access credentials.

5. How the service works

The ordering process works as follows:

  • The user selects a restaurant and products.
  • Confirms the order and makes payment.
  • The restaurant prepares the order.
  • A rider employed by DEGO DELIVERY SL delivers the order to the specified address.

Order confirmation constitutes the formalisation of a contract between the user and the restaurant, with DeGo acting as an intermediary.

6. Payment methods

Payments are made exclusively through secure electronic means via:

  • Bank card
  • Apple Pay
  • Google Pay

Payment is processed at the time of order confirmation.

Cash payments are not accepted.

7. Cancellations

Once payment has been made, the order cannot be cancelled by the user.

This limitation is due to the immediate initiation of the order preparation process by the restaurant.

8. Delivery times

The times displayed in the App are indicative estimates calculated based on various factors (distance, order volume, external conditions, etc.).

DeGo does not guarantee an exact delivery time.

9. Incidents and compensation

In the event of:

  • Delivery with more than 35 minutes delay from the estimated time, when the delay is attributable to the delivery service.
  • Receipt of the order in inadequate conditions attributable to transport.

DeGo may offer compensation in the form of:

  • Promotional discount.
  • Platform credit.
  • Equivalent benefit.

Monetary refunds will not be issued except where legally required.

10. Geographic scope

DeGo's service is provided exclusively in:

  • The municipality of Ontinyent.
  • Certain areas on the outskirts of Ontinyent.

Availability may vary depending on the delivery address entered.

11. User obligations

The user agrees to:

  • Provide correct delivery details.
  • Be available at the specified location.
  • Not place fraudulent orders.
  • Not use the App for unlawful purposes.

12. Account suspension or cancellation

DeGo may suspend or cancel a user's account in the event of:

  • Fraudulent use of the service.
  • Attempts to manipulate the system.
  • Repeated filing of false incidents.
  • Breach of these Terms.

13. Amendments

DeGo may modify these Terms when necessary for legal, technical or service improvement reasons.

Modifications will be notified to users through the App.

14. Data protection

The processing of personal data is governed by DeGo's Privacy Policy, available in the App.

15. Applicable law and jurisdiction

These Terms are governed by Spanish law.

In the event of a dispute, the parties submit to the courts and tribunals of the consumer's domicile.
